Terms and Conditions

  1. General

The terms and conditions of trade of Ritchies Training Centre Limited (hereafter called the Company) are contained herein. Orders accepted are subject to these Terms and Conditions.
These terms and conditions will be for the basis of all contracts with the Company, unless otherwise specified by the Company.

These terms and conditions are correct at the date shown on the relevant course booking form but the Company reserves the right to vary them without notice. An updated copy will be supplied to the client if applicable.

Delegates are required to be punctual at all courses and sessions.

Consumption of alcohol or non-prescription drugs is not permitted during training nor should they be consumed immediately prior to training. The Company will refuse to train any delegates who infringe this condition and will require them to leave Company premises.

Where a delegate is undergoing a course of prescribed drugs they should inform the Company of the nature of the drug and any side effects. The Company may then seek assurance that training can be carried out without risk. The decision of the Company in relation to this is final.

Whilst attending any course with Ritchies the customers must conduct themselves in an appropriate manner. Ritchies reserve the right to terminate a course without notice, should they in their absolute discretion, decide that a Trainee Driver has acted or behave inappropriately, including but not limited to, verbal and physical abuse towards Ritchies staff or DSA staff.
Should it become necessary for the Company to postpone all or any part of a course or other work due to circumstances beyond their control, a mutually agreeable date will be selected on which to complete the work. The company will not be liable for any costs incurred by the client for such actions.

All Customers undertaking any training with the Company are required to adhere to any notices or instructions given to them by any member of the company’s staff.

Where external examinations have been arranged for the customer by the Company, the Company accepts no liability for the accuracy of customer details should a dispute arise with the external examination
In the event that a trainee fails to attend their course for whatever reason including but not limited to certified sickness then all course fees will be forfeited

  1. A. Training Courses – Delegates Requirements (Forklift, Plant)

Where the training being provided is other than theoretical, delegates must provide, unless previously agreed by the Company, their own overalls, protective gloves, safety footwear, waterproof clothing, safety glasses/visor, ear defenders and any other personal safety equipment required.

Certificates are awarded at the discretion of the Company, and only to those who successfully complete the training satisfactorily. Certificates are not issued purely for attendance unless otherwise agreed prior to course commencement, in which case appropriate wording will be used on the certificate.

Course Times: Construction Plant 08.00 – 16.00, Forklift 09.00 – 16.00

  1. B. Training Courses – Delegates Requirements (LGV, PCV)

The student will provide accurate and full information to Ritchies at all times.

The student will be in possession of all necessary legal driving documents at all times while undertaking a course.
It is the responsibility of the student to ensure that their driving licence is valid and that the correct Provisional Entitlement has been added to their driving licence by the DVLA. Any student without the correct entitlement will legally not be allowed to train and all monies paid towards course fees will be forfeited.
The student at the time of their theory or practical driving test will show to the Theory Test Centre and DSA examiner an acceptable form of photographic ID, their current driving licence and, where appropriate, a valid theory test pass certificate, If these conditions are not met the student will fail the relevant test and will forfeit all fees paid to Ritchies in relation to that test.
If the student is considered by Ritchies to be under the influence of alcohol or illegal drugs at any time, the course will be terminated and all relevant fees will be forfeited.

Theory tests and practical tests booked with the DSA by Ritchies on behalf of the student will be subject to the DSA’s terms and conditions in relation to cancellation and / or refund of any monies paid.

In the event of the training vehicle breaking down, Ritchies will arrange for the student to have further training to make up for the lost time.

In circumstances whereby the LGV instructor believes that a student is not fit to take their LGV / PCV / Car practical test – the student will be informed and the test re-scheduled at the students expense.

The company cannot be held responsible for any practical tests being cancelled by DSA (Driving Standards Agency)

Should DSA cancel a practical test, then every effort will be made to arrange a retest for the customer

In the event of a mechanical breakdown the company will provide additional training, equal to the amount of time lost. No refund will be offered.

The company accepts no liability or financial penalty i.e. loss of wages, accommodation etc in respect of mechanical breakdown.

A training day is usually from 08.00 – 16.00 with the student : instructor ratio of 2:1, should a customer require solo training this can be arranged but at equivalent cost.

The company will endeavor to keep customers in the same vehicle for training as much as possible and will not unduly transfer customers from vehicles or instructors. We cannot guarantee the same vehicle or instructor for retests.

  1. Prices

Unless otherwise stated, all prices are inclusive of VAT which is charged at the rate current at the time of due payment.

  1. Settlement Terms

Payment for all training booked and confirmed by the client must be made prior to the commencement date by Cash, Credit / Debit Card.

  1. Health & Safety

Where training is carried out on the Company’s premises, all delegates must conform to and comply with the Health & Safety Policy as laid down by the Company from time to time. Breaches of this policy may result in the delegate being suspended or excluded from the course and premises.

  1. Course Fees

Course Fees: Please contact Ritchies for current course fees.

To reserve your place a non-refundable deposit towards the course fees is payable by cash or credit / debit card.

  1. Cancellation and Postponement

The Company reserve the right to charge a cancellation/postponement fee in respect of courses previously confirmed and subsequently cancelled or postponed. The following refunds will be made in the event of cancellations/postponements prior to course start date

  • More than 14 Days – Full refund (Excluding Deposit)
  • 9-13 Days – 75% refund
  • 5-8 Days – 50% refund
  • 3-4 Days 25% refund
  • 2 days or less – no refund (This time period does not include any weekends)

This does not apply to Crane Training- Once course booked no changes/refund can be made

In accordance with Customer Protection Distance Selling Regulations 2000, when a course is booked without face-to-face contact, the Trainee Driver may cancel a Contract within seven days of that Contract having been concluded. Cancellations must be made in writing and sent by registered post to:

Subject to Distance Selling Regulations 2000 “cooling off period” referred to as above – all monies paid towards the course fees as either deposits, part payments, balance payments or any form of installment payment outside of the aforementioned “cooling off period” are made according to these terms and conditions as stated in section 7.

  1. Applicable Law

Scottish law shall apply and Scottish Courts shall settle any disputes. These terms and conditions do not affect any statutory rights available to the client.

  1. Complaints

Initially any complaint(s) about the course should be directed to the Instructor on the day in question. If the matter is not resolved or you cannot discuss the matter with your instructor the complaint should then be directed to the training manager again this must be on the day in question. No correspondence regarding complaints will be entered into after a course has been completed.

  1. Confidentiality

Ritchies will keep confidential any information, which the Trainee Driver supplies, to Ritchies in connection with this agreement, with the exception of basic personal details, which may be shared with potential employers.

Ritchies will be responsible for ensuring that the processing of personal data complies with the Data Protection Act 1998.

  1. Other Terms

Refreshments during the course will be the delegate’s responsibility

We do not accept responsibility for personal belongings or vehicles left on the premises.

Every effort is made to ensure that both the instructions and handouts / course notes are true and correct at the time but Ritchies Training Centre does not accept any responsibility for any errors or omissions.

Our terms and conditions are readily available on request or from our internet site. All customers are deemed to have read them before requesting our services or products.

This agreement is governed by Scottish Law. Both Ritchies and the customer submit to the exclusive jurisdiction of the Scottish courts in relation to any dispute concerning this agreement.

By booking or leaving a deposit on a course with Ritchies the customer agrees to be bound by the above terms and conditions.
